Social Security Disability Attorneys vs Advocates: An “advocate” is any person you appoint as your representative. Your representative – or advocate – is not required by Social Security to have any professional qualifications. So not all “advocates” are actually attorneys. Hire Disability Attorneys because they can do more for you & fight harder for your case than advocates. The issue and the importance of drug and alcohol use in a social security claim has been the target of some very recent legislation and findings by the social security administration. The rule of law currently is if your disability is the result of alcohol or drugs, you lose. End of the case. We have found in our practice that very often claimants use alcohol and drugs because they’re self medicating. They don’t have money. They can’t see a doctor. They can’t get their Xanax, they can’t get their psychiatric medications so they drink because it makes them feel better.
The issue the becomes the following, this is under a most recent social security ruling. If we were to take the drugs and alcohol out of the equation, in other words the claimant will no longer drink alcohol or use drugs, will they still never the less be disabled. If they would be disabled in any event and it’s a hard burden to prove, you need a skillful attorney to prove that very frankly. But if you took that away and they were still disabled. Then drugs and alcohol are not a meaningful factor and you can still get social security disability. Video Rating: / 5
