1. Do I REALLY need an attorney?
a. This might surprise you, but sometimes you do NOT need to hire an attorney. A trustworthy attorney will be the first to tell you when your matter is something you can handle yourself, or with the help of a different advisor.
b. Of course, there are also MANY situations where you DO need an attorney to properly address your situation.
c. Most attorneys will provide an initial consultation for FREE (or for a nominal fee). At our firm, we use this initial conversation, in part, to determine whether our services are needed, or whether the person can obtain the help they need elsewhere (or through self-help).
2. Is this attorney QUALIFIED to handle my case?
a. Just because someone has a law degree, that does NOT mean that person is qualified to help with your situation. Many attorneys specialize in certain aspects of the law, for example divorces, bankruptcies, criminal matters and estate planning. These are all specialized areas of the law. You do NOT want to retain a criminal law attorney to do your estate planning and vice versa.
3. What will the attorney charge me and what will that fee cover or include?
a. Attorneys are REQUIRED to clearly communicate their fees to the client and to ensure the client knows what they will be billed and exactly what services they will receive in return for such payment.
4. Who will do what?
a. Related to prior question, the attorney should be VERY clear in communicating what services he/she will provide and what work will be left to the client or to others. All of this should be clearly explained by the attorney and agreed to in writing by the client.
5. What is the timeframe for resolution or completion of my matter?
a. Even if the attorney cannot provide an exact date of completion, the attorney should be able to provide an expected time frame.
b. In addition, as the client, you should receive periodic updates from the attorney and, of course, the attorney should respond to your inquiries.

[TRANSCRIPT] When I first started practicing law, I was a legal aid lawyer in Miami, and I was doing some work with some friends of mine, about some punitive action, and they worked with the Public Defender’s office. And I had never wanted to do criminal defense. I just wasn’t interested, and talking to them I realized it was the same client. That is, there were people who were lacking resources and didn’t have an advocate for them, and that made me realize that I should give that a try. And I ended up going to the Public Defender’s office in Miami, and then here in Georgia.
Several years ago, a young man from South Georgia had gotten into some trouble, primarily because he just told some friends that he had gotten a new job. These friends decided to turn what their friend had said into a bank robbery, and someone was killed. And they testified against him in trial but he was acquitted because the jury realized that he was doing nothing more than just explaining to his friends that he had a new job, and all of a sudden, these so-called “friends” took that opportunity and turned it into an armed bank robbery that turned into a murder.
